1. Introduction
1.1 Agreement to Terms
Welcome to GigNGo.org ("GigNGo," "we," "our," or "us"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and GigNGo regarding your access to and use of the website, mobile application, platform, and related services (collectively, the "Platform"). By accessing or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any provision, you must not use or access GigNGo.
1.2 Nature of the Platform
GigNGo.org is a digital marketplace that connects people seeking services ("Clients" or "Consumers") with individuals or businesses offering such services ("Workers" or "Service Providers"). The Platform facilitates communication and connection between users but does not verify or guarantee the identity, qualifications, or background of any user. GigNGo is not a party to any agreements made between Clients and Workers, nor does it control or supervise any work performed or payments exchanged between them. Users engage with one another at their own risk.
1.3 Independent Contractors
All Workers using GigNGo are independent contractors and not employees, agents, or representatives of GigNGo. The Platform does not employ, endorse, or manage any Worker or guarantee the outcome of any services provided.
1.4 Updates to These Terms
GigNGo reserves the right to modify or update these Terms at any time. Any changes will take effect upon being posted on the Platform with a new "Last Updated" date. We may also notify users by email, text, push notification, or in-platform notifications. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.
2. Account Registration and Eligibility
2.1 Account Creation
Users may browse the Platform freely without registering an account. However, to post jobs, apply for work, upload videos, send messages, or hire through GigNGo, you must create an account and provide accurate and up-to-date information. You agree to keep your login credentials secure and are responsible for all activity that occurs under your account. GigNGo is not liable for unauthorized account access resulting from your failure to maintain security.
2.2 Eligibility Requirements
To create an account or use GigNGo's services, you must be at least 18 years old and capable of entering into legally binding agreements. By using the Platform, you represent and warrant that you meet these eligibility requirements. This age restriction applies to all features, including video uploads, messaging, and service transactions.
2.3 Business and Individual Accounts
Both individuals and businesses may use GigNGo. Account features, visibility, and pricing may vary depending on the type of plan selected. GigNGo may request additional information from businesses to verify legitimacy before activating or displaying listings.
2.4 Account Termination and Suspension
GigNGo reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent or illegal behavior, or otherwise disrupts the Platform's integrity. We may also remove listings, videos, or content at our discretion. Termination of your account does not entitle you to any refund or credit, except where required by law.
3. Subscription Plans and Payments
3.1 Subscription Options
GigNGo offers several subscription tiers for Workers, providing varying levels of visibility, listing features, and application limits. Each plan includes a certain number of credits, which are used each time a Worker applies to a posted job. Credits help prevent spam and ensure motivated applicants.
3.2 Billing and Renewal
Subscription payments are processed through third-party payment providers such as Stripe or PayPal. By subscribing, you authorize GigNGo and its payment processor to charge your selected payment method for recurring monthly fees until you cancel your plan. All subscriptions automatically renew each billing cycle unless canceled in advance.
3.3 Cancellation Policy
You may cancel your subscription at any time through your account settings. Upon cancellation, your plan terminates immediately; however, any remaining credits will remain valid until the end of the current billing cycle. GigNGo does not provide refunds for unused time or credits once a billing period has begun.
3.4 No Refunds
All subscription payments are final and nonrefundable, except where prohibited by law. Users are responsible for managing their subscription renewals and cancellations prior to the next billing date.
3.5 Payment Disputes
Because GigNGo does not process or oversee payments between Clients and Workers, we are not responsible for disputes, refunds, damages, or failed payments that occur between users. Any payment-related disagreements must be resolved directly between the involved parties.
3.6 Credit System
Workers receive a monthly allocation of application credits based on their subscription tier. Credits are consumed when applying to posted jobs. The credit system operates as follows:
- Credit Allocation: Each subscription tier provides a specific number of credits per month (e.g., Free: 5 credits, Basic: 20 credits, Pro: 50 credits, Premium: unlimited).
- Credit Usage: One credit is deducted for each job application submitted.
- Monthly Reset: Credits reset on your subscription anniversary date each month (the same day of the month you started your subscription).
- No Rollover: Unused credits do not carry over to the next billing cycle.
- No Refunds: Credits are non-refundable and have no cash value.
- No Transfers: Credits cannot be transferred between accounts or sold to other users.
3.7 Boost Listings
GigNGo offers a paid "Boost" feature that temporarily increases the visibility of a Worker's listing in search results and the main feed. Boost purchases operate as follows:
- Duration: Each Boost provides enhanced visibility for a fixed period of four (4) hours from the time of purchase.
- One-Time Purchase: Boosts are purchased individually through Stripe and are not part of your subscription plan.
- No Refunds: Boost purchases are final and nonrefundable. Once activated, a Boost cannot be paused, extended, or transferred.
- No Guarantee of Results: Boosting a listing increases its visibility but does not guarantee views, applications, or hires.
- Automatic Expiration: Boosts expire automatically after the four-hour window. No further action is required.
- Stacking: Multiple Boosts may not be stacked or combined for extended durations.
3.8 Referral Program
GigNGo offers a referral program that rewards users for sharing the Platform with others. The referral program operates as follows:
- Referral Links: Each user receives a unique referral link that can be shared via social media, email, messaging, or any other channel.
- Credit Reward: When a new user signs up through your referral link, you may receive a one-time bonus application credit as a reward.
- Eligibility: Referral credits are awarded only for genuine new user signups. Self-referrals, fake accounts, or fraudulent signups do not qualify.
- Non-Transferable: Referral credits cannot be transferred between accounts, exchanged for cash, or sold.
- Program Changes: GigNGo reserves the right to modify, suspend, or terminate the referral program at any time without prior notice.
- Fraud Prevention: Abuse of the referral program (including creating fake accounts or using bots) may result in forfeiture of credits and account suspension.
3.9 Big Jobs
Certain subscription tiers (Business and Enterprise) include access to "Big Jobs," which are high-value job postings that bypass standard application limits:
- Monthly Allocation: Business tier subscribers receive three (3) Big Job applications per month; Enterprise tier subscribers receive ten (10).
- No Rollover: Unused Big Job allocations do not carry over to the next billing cycle.
- Eligibility: Big Jobs are available only to Workers on qualifying subscription tiers.
- No Refunds: Big Job allocations are nonrefundable and have no cash value.
4. Use of the Platform
4.1 Permitted Use
The Platform may be used only for lawful purposes and in accordance with these Terms. Users agree to comply with all applicable federal, state, and local laws and regulations when using GigNGo.
4.2 Prohibited Activities
Users must not:
- Post or request illegal, unsafe, or inappropriate services.
- Impersonate another person or misrepresent affiliation with any entity.
- Engage in harassment, spam, discrimination, or hate speech.
- Circumvent subscription limits, manipulate ratings, or misuse messaging features.
- Upload harmful code, viruses, malware, or automated bots that disrupt the Platform's function.
- Scrape, crawl, or use automated tools to extract data from the Platform.
- Attempt to gain unauthorized access to any part of the Platform or other users' accounts.
- Use the Platform to distribute unsolicited commercial messages or advertisements.
GigNGo may suspend or terminate accounts that engage in prohibited activities without prior notice.
4.3 Direct Communication
Depending on plan type, users may exchange direct contact information (such as phone numbers or social links) or communicate via the in-app messaging system. Users are responsible for their own safety and discretion when sharing personal information.
4.4 Reporting and Enforcement
Content that is illegal, fraudulent, misleading, or unrelated to the Platform's purpose may be reported by users or removed by GigNGo at our sole discretion. Repeated violations may result in account suspension or permanent removal.
4.5 Video Content and Inspiration Feed
GigNGo provides a video-based inspiration feed ("GigFeed" or "Watch Feed") where Workers can upload and share videos showcasing their skills, completed projects, and services. By uploading videos, you agree to the following:
4.5.1 Video Upload Requirements
- Age Restriction: You must be at least 18 years old to upload videos.
- File Format: Videos must be in MP4, MOV, or WebM format.
- File Size: Maximum file size is 500MB per video.
- Duration: Videos must be between 5 seconds and 3 minutes in length.
- Content Quality: Videos should be clear, relevant, and professionally representative of your services.
4.5.2 Content Guidelines
Videos must not contain:
- Illegal activities or content promoting illegal behavior.
- Nudity, sexual content, or sexually suggestive material.
- Violence, graphic content, or content that promotes harm.
- Hate speech, harassment, bullying, or discriminatory content.
- Copyrighted material you do not have rights to use (music, images, video clips).
- Misleading or deceptive content about services or qualifications.
- Spam, irrelevant content, or excessive promotional material.
- Personal information of others without their consent.
4.5.3 Video Hosting and Processing
- Videos are uploaded to and hosted by Cloudflare Stream, a third-party video hosting service.
- GigNGo automatically generates thumbnails from your uploaded videos.
- Videos are transcoded into multiple formats and resolutions for optimal playback.
- Video processing may take several minutes; videos will appear in your profile once processing is complete.
4.5.4 License Grant for Videos
By uploading a video to GigNGo, you grant GigNGo a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:
- Host, store, and display your video on the Platform.
- Create thumbnails, previews, and derivative works from your video.
- Distribute your video through content delivery networks (CDNs).
- Use your video in marketing, promotional, and advertising materials.
- Transcode your video into multiple formats, resolutions, and bitrates.
- Display your video in search results, recommendations, and category feeds.
This license survives termination of your account for videos that have been shared, embedded, or distributed prior to termination.
4.5.5 Content Moderation
GigNGo reserves the right to:
- Review, moderate, and approve videos before they appear publicly.
- Remove, hide, or flag videos that violate these Terms or community guidelines.
- Suspend or terminate accounts that repeatedly upload prohibited content.
- Use automated systems and AI to detect inappropriate or illegal content.
- Respond to copyright infringement claims under the DMCA (see Section 11).
4.5.6 Video Analytics
GigNGo tracks video engagement metrics including view count, like count, share count, watch time, completion rate, and geographic distribution of viewers. These metrics may be visible to you and, in some cases, to other users.
4.6 Quote Request System
Workers may enable a "Quote Request" feature that allows Consumers to request price quotes directly from videos in the GigFeed. This feature operates as follows:
4.6.1 Worker Settings
- Workers can enable or disable quote requests in their account settings.
- Workers can set a budget range (minimum and maximum) for quote requests they wish to receive.
- Only quote requests within the worker's specified budget range will be shown to Consumers.
4.6.2 Consumer Experience
- Consumers viewing videos from nearby workers (within 50 miles) who accept quote requests will see a "Request Quote" button.
- Clicking the button opens a form to describe the job and budget.
- Quote requests are sent via the in-app messaging system.
4.6.3 No Guarantee of Response
GigNGo does not guarantee that workers will respond to quote requests. Workers are not obligated to provide quotes or accept jobs. Quote requests are subject to workers' availability and preferences.
4.7 External Job Board Distribution
To maximize visibility and increase the likelihood of finding qualified Workers, GigNGo may automatically distribute job postings to external platforms and job boards. By posting a job on GigNGo, you acknowledge and agree to the following:
4.7.1 Platforms and Channels
Job postings may be distributed to third-party platforms including but not limited to:
- Craigslist (with automatic removal when the job is filled)
- Bark.com
- Facebook Marketplace
- Facebook Groups (relevant local or industry groups)
- Facebook Page direct messages
- Other job boards or listing services as determined by GigNGo
4.7.2 Content Shared Externally
- Job title, description, category, and budget range may be shared on external platforms.
- Your GigNGo username or display name may be included in external postings.
- Your exact contact information (email, phone, address) is never shared on external platforms.
- All external postings link back to GigNGo for applications and communication.
4.7.3 Timing and Business Hours
- External postings are scheduled during business hours (Monday–Saturday, 8 AM–8 PM Eastern Time) to comply with platform guidelines and best practices.
- Outreach may occur in multiple waves (e.g., at posting time, 12 hours later, 24 hours later) to maximize reach.
- GigNGo reserves the right to adjust timing and frequency of external postings.
4.7.4 Removal
- External postings are automatically removed when a job is filled, expired, or deleted on GigNGo.
- Users may request removal of external postings by contacting support@gigngo.org.
- GigNGo is not responsible for cached or archived copies of external postings retained by third-party platforms.
4.8 SMS Communications and TCPA Compliance
GigNGo may send SMS (text) messages to your registered phone number. By providing your phone number and using the Platform, you consent to receive SMS communications from GigNGo. SMS communications are governed by the following terms:
4.8.1 Types of SMS Messages
- Transactional Messages: Account verification, password resets, security alerts, and payment confirmations.
- Notification Messages: New job postings near you, application updates, messages from other users, and quote requests.
- Marketing Messages: Promotional offers, platform updates, and re-engagement messages (with your consent).
4.8.2 TCPA Compliance
- GigNGo complies with the Telephone Consumer Protection Act (TCPA) and all applicable federal and state regulations regarding SMS communications.
- Marketing SMS messages are sent only during permitted hours (8 AM–8 PM in your local time zone).
- You may opt out of non-essential SMS messages at any time by replying "STOP" to any message or adjusting your notification settings in the app.
- Transactional messages (account security, payment confirmations) cannot be opted out of while your account is active.
- Message and data rates may apply depending on your mobile carrier and plan.
4.8.3 SMS Service Provider
SMS messages are sent through Twilio, a third-party communications platform. Your phone number is shared with Twilio solely for the purpose of delivering messages. Twilio's privacy practices are governed by their privacy policy: https://www.twilio.com/legal/privacy
4.9 Following System
Users may follow other users on GigNGo to receive updates about their activity, new videos, and service offerings. The following system operates as follows:
- Following is public; other users can see your follower and following counts.
- You may unfollow any user at any time.
- Following does not grant access to private information or direct messaging privileges beyond what your subscription allows.
- GigNGo reserves the right to limit following activity to prevent spam or abuse.
4.10 Scheduling and Calendar Features
GigNGo provides scheduling tools within the messaging system to help Clients and Workers coordinate service appointments:
- Scheduling Suggestions: AI-powered suggestions for meeting times based on conversation context.
- Add to Calendar: Users can add scheduled appointments to their device calendar (Google Calendar, Apple Calendar, etc.).
- Calendar integration requires your device's permission and may share appointment details with your calendar provider.
- GigNGo does not guarantee appointment fulfillment or enforce scheduled times between users.
4.11 Google Business and Social Account Connections
Workers may connect third-party accounts to enhance their GigNGo profiles:
- Google Business Profile: Connect your Google Business Profile to import business details, reviews, and verification status.
- Facebook Page: Connect your Facebook Page to import business information and reviews.
- Connecting third-party accounts requires OAuth authorization. GigNGo accesses only the information you authorize and does not post to your accounts without your permission.
- You may disconnect third-party accounts at any time through your account settings.
- Imported data is subject to GigNGo's Terms and Privacy Policy.
4.12 Review Import
Workers may import reviews from external platforms (such as Google Business or Facebook) to display on their GigNGo profile:
- Imported reviews are clearly labeled as originating from external sources.
- GigNGo does not verify the authenticity of imported reviews and is not responsible for inaccurate or fraudulent external reviews.
- Workers are responsible for ensuring they have the right to display imported reviews on GigNGo.
- GigNGo reserves the right to remove imported reviews that appear fraudulent, misleading, or in violation of these Terms.
5. User Content and Intellectual Property
5.1 Ownership of User Content
Users may upload or post materials such as job listings, service descriptions, photos, videos, portfolios, reviews, and profile information (collectively, "User Content"). While you retain ownership of the original materials you submit, you grant GigNGo.org a perpetual, worldwide, royalty-free, transferable license to use, host, display, distribute, modify, and reproduce such content for purposes related to operation, marketing, SEO visibility, and promotion of the Platform. This license survives termination of your account.
5.2 Platform Ownership
All intellectual-property rights in the Platform—including but not limited to its design, functionality, features, code, text, graphics, trademarks, and logos—are owned or licensed by GigNGo.org. You may not copy, modify, distribute, reverse-engineer, or otherwise exploit any part of the Platform except as expressly permitted by these Terms.
5.3 Visibility After Account Deletion
When a user deletes an account, related public listings may remain visible in search results or directories for a limited time due to caching, indexing, or SEO purposes. Portfolios, reviews, and other personal data will be deleted or anonymized as practical. GigNGo reserves the right to retain minimal data for legitimate business, recordkeeping, or legal reasons.
5.4 Third-Party Links and Portfolios
Users may include external links (for example, to Instagram, YouTube, or other portfolios) within the "Connect" or profile sections. GigNGo is not responsible for any content, data collection, or availability on those external websites. Accessing external links is entirely at your own risk.
5.5 AI-Powered Features
GigNGo uses artificial intelligence and machine learning technologies to enhance the Platform experience. These AI-powered features include:
5.5.1 AI Categorization
- Task Categorization: AI automatically categorizes work requests into appropriate service categories based on job descriptions.
- Video Categorization: AI analyzes video content to suggest appropriate categories, tags, and keywords.
- Skill Matching: AI helps match workers with relevant job opportunities based on their profiles and past work.
5.5.2 Illegal Content Detection
- GigNGo employs automated systems to detect potentially illegal or prohibited content in job postings, messages, and video uploads.
- Content flagged by AI systems may be blocked immediately or held for manual review.
- Detection systems scan for keywords and patterns associated with illegal drugs, weapons, stolen goods, fraud, human trafficking, violence, and other prohibited activities.
- The system supports multiple languages including English and Spanish.
5.5.3 AI Pricing Suggestions
- Price Estimates: GigNGo may use AI to generate suggested price ranges for job postings based on category, location, complexity, and historical data.
- Advisory Only: AI-generated pricing is provided as a suggestion only and does not constitute a binding quote, guarantee of cost, or professional appraisal.
- No Liability: GigNGo is not responsible for pricing decisions made by users based on AI suggestions. Final pricing is always determined by the Client and Worker.
5.5.4 AI Limitations and Disclaimers
- AI systems are not perfect and may produce false positives or miss prohibited content.
- GigNGo does not guarantee the accuracy of AI categorization or content detection.
- Users may appeal AI decisions by contacting support@gigngo.org.
- Final decisions on content moderation are made by GigNGo staff.
- GigNGo does not use your content to train AI models or sell data to third parties for AI training purposes.
5.6 Location Services and Privacy
GigNGo uses location data to connect users with nearby services and opportunities. To protect user privacy, we implement location fuzzing:
5.6.1 Location Fuzzing Methodology
- When workers set their location for notifications and map display, their exact coordinates are stored securely but never displayed publicly.
- A random offset between 0.2 and 0.8 miles is applied when displaying worker locations on maps.
- The offset distance and direction are randomized each time the map loads.
- This prevents users from determining a worker's exact home or business address.
5.6.2 Signup Location Data
When you create an account, GigNGo automatically detects and permanently records your city and state at the time of registration. This data is used to:
- Monitor marketplace health and ensure adequate coverage of service providers and consumers in each geographic area.
- Identify underserved locations where additional outreach or recruitment may be needed.
- Generate aggregated geographic distribution reports for internal platform analytics.
This signup location is stored separately from your editable profile location and is not publicly visible. By creating an account, you consent to this data collection as described in our Privacy Policy.
5.6.3 Exact Location Usage
- Exact coordinates are used server-side for accurate proximity calculations (e.g., determining which workers are within 200 miles of a posted job).
- Push notifications include accurate distance calculations based on exact coordinates.
- Exact coordinates are never shared with other users or displayed in the user interface.
5.6.4 User Control
- Workers can view their exact coordinates in their profile settings.
- Workers can update or remove their location at any time.
- Workers can disable location-based notifications in their settings.
- Deleting your account permanently removes all location data.
5.7 Satellite Domains and Multi-Domain Operation
GigNGo operates across multiple domains to improve discoverability and serve users through various branded experiences. These domains include but are not limited to:
- gigngo.org (primary domain)
- giggo.org
- gigmarketplace.org
- gigsmarket.org
- gigsmarketplace.org
- jobmarketplace.org
- workmarketplace.org
By using GigNGo, you acknowledge and agree that:
- Your public profile, listings, videos, and reviews may appear on any of these domains.
- All domains share the same underlying platform, database, and user accounts.
- These Terms and our Privacy Policy apply equally across all GigNGo-operated domains.
- GigNGo may add or remove satellite domains at any time without prior notice.
5.8 Search Engine Indexing and Auto-Indexing
GigNGo proactively submits public user content to search engines to improve discoverability and help Workers attract Clients. This includes:
- Server-Side Rendering (SSR): Worker profiles are rendered server-side to enable rich search engine previews with your name, photo, title, bio, and service area.
- IndexNow Submissions: When you create or update your profile, GigNGo may submit your public profile URL to search engines (including Bing and Yandex) via the IndexNow protocol for faster indexing.
- Automatic Indexing: Public profiles are automatically included in our sitemap and submitted to Google Search Console for indexing.
- Opt-Out: If you do not want your profile indexed by search engines, you may contact support@gigngo.org to request exclusion. Note that deleting your account automatically removes your profile from our sitemap, though cached copies may persist in search engine results until refreshed.
6. Liability and Disclaimers
6.1 Platform "As-Is"
The GigNGo Platform is provided on an "as-is" and "as-available" basis. We make no warranties or representations of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, reliability, availability, or non-infringement. We do not guarantee that the Platform will always function without disruptions, delays, or errors.
6.2 Marketplace Disclaimer
GigNGo is a connection service only. We do not employ, endorse, or control Workers or Clients. We are not responsible for, and make no representations regarding, the quality, timing, legality, pricing, or safety of any services performed or received. All transactions, communications, and work performed are strictly between the involved users.
6.3 User Responsibility
You acknowledge that you are solely responsible for conducting any background checks, verifying identities, reviewing qualifications, and ensuring compliance with laws before hiring or performing services. GigNGo assumes no responsibility for verifying such information or for any damages arising from user interactions.
6.4 Video Content Liability
GigNGo is not responsible for user-generated video content uploaded to the Platform. Users who upload videos are solely responsible for:
- Ensuring they own or have proper licenses for all content in their videos (including music, images, and video clips).
- Ensuring videos do not infringe on any third-party copyrights, trademarks, or other intellectual property rights.
- Ensuring videos comply with all applicable laws and regulations.
- Any claims, damages, or legal actions arising from their uploaded videos.
GigNGo operates as a service provider under the Digital Millennium Copyright Act (DMCA) and is protected by safe harbor provisions for user-generated content (see Section 11).
6.5 Third-Party Services
The Platform integrates with various third-party services including Firebase, Cloudflare Stream, OneSignal, Stripe, PayPal, and others. GigNGo is not responsible for the availability, functionality, security, or privacy practices of these third-party services. Your use of third-party services is subject to their respective terms and privacy policies.
7. Limitation of Liability and Indemnification
7.1 Limitation of Liability
To the maximum extent permitted by law, GigNGo and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, goodwill, data, or other intangible losses arising out of or related to the use of the Platform.
If, notwithstanding the foregoing, GigNGo is found liable to you for any damages, such liability shall in no event exceed the total amount paid by you (if any) to GigNGo in the twelve (12) months preceding the event giving rise to the claim.
7.2 Indemnification
You agree to defend, indemnify, and hold harmless GigNGo, its affiliates, and their respective officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from or related to:
- Your use or misuse of the Platform.
- Your violation of these Terms.
- Your violation of any rights of another user or third party.
- Your content or conduct, including videos, job postings, messages, and reviews.
- Copyright infringement claims related to your uploaded videos or other content.
- Any services you provide or receive through the Platform.
8. Termination of Use
8.1 By the User
You may stop using the Platform or delete your account at any time through your profile settings. Deletion is permanent and may result in loss of stored information or listings.
8.2 By GigNGo
GigNGo reserves the right to suspend or terminate any account or access to the Platform at any time and for any reason, including violation of these Terms, illegal conduct, copyright infringement, or harm to other users or the reputation of the Platform.
8.3 Effect of Termination
Upon termination, all rights granted to you under these Terms will immediately cease. Any provisions that, by their nature, should survive termination (including ownership, warranty disclaimers, limitation of liability, and indemnification) will remain in effect.
8.4 Content Retention After Termination
- Most user content (profiles, listings, reviews) will be deleted upon account termination.
- Videos may remain temporarily in CDN caches or search engine indexes until refreshed.
- Messages may be retained for up to 60 days for fraud prevention and legal compliance.
- GigNGo may retain minimal data as required by law or for legitimate business purposes.
9. Governing Law and Dispute Resolution
9.1 Governing Law
These Terms and any disputes arising from or relating to your use of the Platform shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict-of-law principles.
9.2 Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved informally by contacting support@gigngo.org.
If unresolved, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall take place in Michigan unless both parties agree otherwise. The arbitration award shall be final and binding. Each party shall bear its own costs unless otherwise determined by the arbitrator.
9.3 Small-Claims and Injunctive Relief
Nothing in this section prevents either party from seeking resolution in small-claims court or requesting injunctive or equitable relief for violations of intellectual-property rights or unauthorized use of the Platform.
10. Miscellaneous Provisions
10.1 Entire Agreement
These Terms constitute the entire agreement between you and GigNGo concerning your use of the Platform and supersede all prior agreements or understandings, whether written or oral.
10.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
10.3 Waiver
Failure by GigNGo to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision in any instance.
10.4 Assignment
You may not assign or transfer these Terms or any rights or obligations herein without prior written consent from GigNGo. We may assign our rights or obligations under these Terms at any time without notice.

Notices required or permitted under these Terms may be sent by email to support@gigngo.org or through any other method of communication we provide on the Platform.
11. Digital Millennium Copyright Act (DMCA)
11.1 Copyright Policy
GigNGo respects the intellectual property rights of others and expects users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (17 U.S.C. § 512).
11.2 DMCA Takedown Procedure
If you believe that your copyrighted work has been uploaded to GigNGo without authorization, you may submit a DMCA takedown notice to our designated agent:

Your notice must include:
- A physical or electronic signature of the copyright owner or authorized representative.
- Identification of the copyrighted work claimed to have been infringed.

- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
11.3 Counter-Notification
If your content was removed due to a DMCA takedown notice and you believe the removal was erroneous, you may submit a counter-notification to support@gigngo.org.
Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed by mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or Michigan if outside the U.S.), and that you will accept service of process from the person who filed the original DMCA notice.
11.4 Repeat Infringer Policy
GigNGo will terminate the accounts of users who are determined to be repeat copyright infringers. A repeat infringer is a user who has been notified of infringing activity more than twice or has had content removed from the Platform more than twice.
11.5 False Claims
Submitting a false or fraudulent DMCA notice or counter-notification may result in legal liability. You may be liable for damages, including costs and attorney's fees, if you materially misrepresent that content is infringing or was removed by mistake.
12. Content Moderation and Enforcement
12.1 Automated Moderation
GigNGo uses automated systems, including artificial intelligence, to detect and prevent prohibited content from appearing on the Platform. These systems scan job postings, video uploads, messages, and user profiles for illegal services, inappropriate content, harassment, spam, or fraudulent information.
12.2 Manual Review
Content flagged by automated systems or reported by users may be reviewed manually by GigNGo staff. Manual review may result in content removal, account warnings, account restrictions, account suspension, account termination, or reporting to law enforcement (for illegal activity).
12.3 Enforcement Actions
GigNGo may take the following enforcement actions for Terms violations:
- Warning: First-time or minor violations may result in a warning.
- Content Removal: Specific content (posts, videos, messages) may be removed.
- Feature Restriction: Access to specific features (messaging, video uploads) may be restricted.
- Account Suspension: Temporary suspension (7-30 days) for serious or repeated violations.
- Account Termination: Permanent removal from the Platform for severe violations or repeat offenders.
12.4 Appeal Process
If you believe an enforcement action was taken in error, you may appeal by contacting support@gigngo.org with your account information, description of the enforcement action, explanation of why you believe it was erroneous, and any supporting evidence or documentation. Appeals will be reviewed within 5-10 business days. GigNGo's decision on appeals is final.
12.5 Reporting Violations
Users can report violations of these Terms by using the "Report" button on content (videos, profiles, job postings), sending an email to support@gigngo.org with details and evidence, or using the in-app reporting feature in the messaging system. All reports are reviewed, but GigNGo cannot guarantee a response to every report or that action will be taken.
